Course Objectives

Students will be able to explain the differences and similarities between liquidation-type insolvency proceedings and reorganization-type insolvency proceedings.
Students will be able to explain several recent concrete cases (judicial precedents).

Overview
This course primarily covers the Civil Rehabilitation Act. The first half focuses on the procedural aspects of rehabilitation proceedings, while the second half addresses their substantive aspects. Throughout the course, special emphasis is placed on the similarities and differences between rehabilitation proceedings and bankruptcy proceedings. The goals of the course are as follows:

To develop an understanding of the basic concepts underlying both liquidation-type and reorganization-type insolvency proceedings.
To build foundational skills for explaining what types of procedures are available to corporations or individuals facing multiple debts or insolvency.
