Class Objectives /Class Outline |
Goals The aim of this course is to help students overcome areas of weakness while using those areas as a foundation for developing a solid thinking framework for dispute resolution. Students will learn to identify the issues in case problems and explore possible solutions by referring to statutory provisions, fundamental principles, and basic theories. Rather than being constrained by the pursuit of a single “correct answer,” students are expected to explain, step by step and as a coherent process, how to achieve a smart and persuasive resolution of cases. Overview This course focuses on areas of the General Part and Special Part of criminal law that students typically struggle with. Through interactive Q&A with the instructor and multidirectional discussion, students will use these topics as material for case analysis.
To refine the problem‑solving methods learned in Integrated Exercises in Criminal Law and Advanced Exercises in Criminal Law I by applying them to complex case problems in which multiple important theories of criminal law—both from the General Part and Special Part—interact cooperatively or conflict with one another. To further develop students’ abilities to identify issues in criminal law, distinguish whether factual differences are legally significant, and construct multiple potential solutions to newly emerging problems from several perspectives. |
