Class Objectives /Class Outline |
In this course, students will select themes from the fields of family law and succession law and deepen their understanding of those themes through an analysis of legal frameworks and the development of case law. By examining legislative intent, the evolution of judicial decisions, and trends in legal scholarship, the course aims to cultivate the ability to understand and appropriately position selected court cases within the broader legal context. Students will also develop the ability to analyze and discuss challenges inherent in the current legal system.
Based on a foundational understanding of the issues and themes in family law and succession law addressed in the seminar, students will be assessed according to the following criteria: (1) The ability to appropriately summarize the facts and holdings of the selected judicial decisions. (2) The ability to explain the outline of the legal framework related to the selected theme (including legislative intent and subsequent interpretation), with reference to the positioning of the cases discussed in (1). (3) The ability to develop logical and coherent discussions based on the selected theme. |

Sessions 1–2: Guidance; foundational knowledge for theme selection; determination of themes Sessions 3–14: Student presentations on individual themes, followed by discussions Session 15: Course summary and review
Themes will be determined through consultation and, as far as possible, will reflect students’ academic interests. Example Themes: - Introduction of an optional separate surname system for married couples - Same-sex marriage - Legal parent–child relationships and assisted reproductive technology - Joint parental authority after divorce / child support and child contact - Child abuse, alternative care, and the adoption system - Elderly support obligations and supervisory liability - Legal effects of succession - Testamentary capacity of elderly persons - Statutory reserved portion |
