Class Objectives /Class Outline |
[Goals] (1) To acquire an understanding of the overall structure and fundamental concepts of the Civil Code, including the Pandekten system, the distinction between property law and family law, and the distinction between the law of real rights and the law of obligations. (2) To understand and explain the major legal issues arising in the General Provisions of the Civil Code. (3) To cultivate the ability to accurately identify the points at issue in specific dispute cases and to resolve them appropriately from a practical and doctrinal perspective by applying basic legal knowledge.
[Overview] This course is conducted on the assumption that students already possess a certain level of knowledge regarding the legal institutions contained in the “General Provisions” section of the Civil Code, which sets out rules common to the entire code (real rights, claims, family relations, and inheritance), and also covers the interpretation and practical application of these institutions. The main topics covered are: (1) the subjects and objects of rights, (2) legal acts, (3) agency, and (4) prescription. The course aims to ensure a solid understanding of the fundamental legal concepts and institutions related to the General Provisions, and to enable students to explain everyday legal issues—such as sales and lease contracts—from a practical perspective, including issues such as the allocation of the burden of proof in litigation. To achieve these goals, the course will explain the significance of the relevant legal institutions and regulations. It will also deepen students’ practical understanding of these institutions by examining specific examples. |

Students must have completed the following undergraduate courses: General Provisions of Civil Law I and II, Property Law I and II, and Contract Law. This course is available to students who enrolled in or after the 2024 (Reiwa 6) academic year. |
